Isa sa basic rights natin sa 1987 Constitution, ang kalayaan mula sa sapilitang pagtatrabaho:
Article III, Section 18 (2) : “No involuntary servitude in any form shall exist except as a punishment for a crime whereof the party shall have been duly convicted.”
Sabi nga ng Supreme Court: “An individual employee can, at any time… walk away from it… a contrary rule would violate the involuntary service provision of the Constitution.”
Kung magre-resign sa trabaho- tandaan lang na sa batas, required ang at least 1-month advance notice.
Kung hindi sundin ang advance-notice requirement- pwede kayong singilin ng danyos.
Ang immediate resignation, pwede lang kung may malalang abusong ginawa sa inyo ang employer, sa ganitong sitwasyon:
- Serious insult on the honor and person of the employee;
- Inhuman and unbearable treatment;
- Commission of a crime or offense against the the employee or any of the immediate members of his family; and
- Other analogous causes
Pwede rin ang immediate resignation, kung payag naman ang employer.
Muli- may karapatan kayong mag-resign kung ayaw niyo na sa trabaho ninyo.
