Para mapalitan ang sex sa inyong birth certificate, ayon sa ating batas na Republic Act No. 10172, maaaring ipapalit ang maling entry na nakalagay sa birth certificate (kasama ang pangalan, sex, birth date or month) kung malinaw na pawang clerical o typographical ang kamalian sa pamamagitan ng pagfile ng Petition for Correction of Clerical Error sa local civil registrar (LCR) kung saan naka-register ang iyong birth certificate. Ang petition na ito ay administrative lamang at hindi kailangang dumaan sa korte.
Ayon sa nasabing batas, “Clerical or typographical error” refers to a mistake committed in the performance of clerical work in writing, copying, transcribing or typing an entry in the civil register that is harmless and innocuous, such as misspelled name or misspelled place of birth, mistake in the entry of day and month in the date of birth or the sex of the person or the like, which is visible to the eyes or obvious to the understanding, and can be corrected or changed only by reference to other existing record or records: Provided, however, That no correction must involve the change of nationality, age, or status of the petitioner.
Kailangan ng mga sumusunod na supporting documents para sa petisyon:
(1) A certified true machine copy of the certificate or of the page of the registry book containing the entry or entries sought to be corrected or changed;
(2) At least two (2) public or private documents showing the correct entry or entries upon which the correction or change shall be based;
(3) pinakamaagang school record or dokumento gaya ng medical records, katibayan ng baptism o iba pang dokumento galling sa religious authorities;
(4) Certification mula sa mga accredited na doctor ng gobyerno na nagpapatunay na ikaw ay hindi dumaan sa isang sex change o sex transplant;
(5) Receipt of payment of filing fee;
(6) Notice and Certificate of posting; and
(7) Other documents which the petitioner or the city or municipal civil registrar or the consul general may consider relevant and necessary for the approval of the petition.
Kailangan din itong ipublish at least once a week for 2 consecutive weeks sa isang newspaper of general circulation.
Ayon sa PSA website, ang fees para sa ganitong petition ay P1,000.00
