Hindi lang mga pisikal na pagkilos ang tinuturing na sexual harassment.
Sa Safe Spaces Act (Republic Act No. 11313), may parusa ang anumang uri ng sexual harassment – maging sa babae man o sa lalake — sa kalsada at iba pang public spaces tulad ng malls, bars, restaurants, terminals, PUVs, pati na mga pribadong sasakyan na saklaw ng transport network apps.
Kabilang dito ang:
- Wolf-whistling
- Catcalling
- Leering and intrusive gazing
- Taunting
- Unwanted invitations
- Misogynistic, transphobic, homophobic, and sexist slurs, gestures, or actions
- Persistent unwanted comments on one’s appearance
- Relentless requests for one’s personal details (name, contact and social media details or destination)
- Persistent telling of sexual jokes, use of sexual names, comments and demands
- And any statement that has made an invasion on a person’s personal space or threatens the person’s sense of personal safety.
May parusang multa at mandatory attendance sa Gender Sensitivity Seminar for the first offense, at pagkakakulong sa mga susunod na paglabag.
- The first offense shall be punished by a fine of One thousand pesos (P1,000.00) and community service of twelve (12) hours inclusive of attendance to a Gender Sensitivity Seminar to be conducted by the PNP in coordination with the LGU and the PCW;
- The second offense shall be punished by arresto menor (6 to 10 days) or a fine of Three thousand pesos (P3,000.00);
- The third offense shall be punished by arresto menor (11 to 30 days) and a fine of Ten thousand pesos (P10,000.00).
May mas mataas na parusa naman para sa stalking at physical touching, pinching, or brushing against the victim’s body:
- The first offense shall be punished by arresto menor (11 to 30 days) or a fine of Thirty thousand pesos (P30,000.00),provided that it includes attendance in a Gender Sensitivity Seminar, to be conducted by the PNP in coordination with the LGU and the PCW;
- The second offense shall be punished by arresto mayor (1 month and 1 day to 6 months) or a fine of Fifty thousand pesos (P50,000.00);
- The third offense shall be punished by arresto mayor in its maximum period or a fine of One hundred thousand pesos (P100,000.00).
Kung makaranas ng ganitong sexual harrassment sa public spaces, lumapit agad sa MMDA o PNP sa lugar para ipahuli ang nambastos. Kung nasa bar o restaurant, ipaalam agad sa kanilang security para makatawag ito ng pulis.
Gender-Based Online Sexual Harassment
Ang harassment ay ‘di lamang face-to-face- pinaparusahan ito kahit online ginawa. Kasama dito ang:
- physical, psychological, and emotional threats
- unwanted sexual misogynistic, transphobic, homophobic and sexist remarks and comments online whether publicly or through direct and private messages
- invasion of victim’s privacy through cyberstalking and incessant messaging
Pinaparusahan ito ng pagkakakulong mula two (2) years, four (4) months and one (1) day to four (4) years and two (2) months at/omulta na hindi bababa sa P100,000 o hindi hihigit sa P500,000, depende sa diskresyon ng hukuman.
