Sa Safe Spaces Act (o R.A 11313) , bawal ang bastos.
Ang batas na ito, nilalayóng protektahan ang lahat ng tao- at kinikilala na both men and women must have equality, security, and safety on the streets and in public spaces.
Pinaparusahan ang “unwanted and uninvited sexual actions or remarks,” regardless sa motibo sa paggawa nito.
Kasama sa pinaparusahan ang:
- a) Wolf-whistling
- b) Catcalling
- c) Misogynistic, transphobic, homophobic, and sexist slurs
- d) Persistent unwanted comments on one’s appearance
- e) Relentless requests for personal details
- f) Persistent telling of sexual jokes
- g) Use of sexual names, comments, and demands
- h) Any statement that has made an invasion on one’s personal space or threatens their sense of safety
Ang parusa sa mga ito- multa na umaabot hanggang P10,000 at pagkakakulong hanggang 30 days.
- The first offense shall be punished by a fine of One thousand pesos (P1,000.00) and community service of twelve (12) hours inclusive of attendance to a Gender Sensitivity Seminar to be conducted by the PNP in coordination with the LGU and the PCW;
- The second offense shall be punished by arresto menor (6 to 10 days) or a fine of Three thousand pesos (P3,000.00);
- The third offense shall be punished by arresto menor (11 to 30 days) and a fine of Ten thousand pesos (P10,000.00).
Kung pisikal na ang pambabastos- halimbawa stalking o paghawak sa sensitive parts of the person’s body, mas mataas na parusa- multang umaabot sa P100,000 o pagkakakulong hanggang 6 months.
- The first offense shall be punished by arresto menor (11 to 30 days) or a fine of Thirty thousand pesos (P30,000.00), provided that it includes attendance in a Gender Sensitivity Seminar, to be conducted by the PNP in coordination with the LGU and the PCW;
- The second offense shall be punished by arresto mayor (1 month and 1 day to 6 months) or a fine of Fifty thousand pesos (P50,000.00);
- The third offense shall be punished by arresto mayor in its maximum period or a fine of One hundred thousand pesos (P100,000.00).
Kung maranasan ninyo ito- i-report agad sa pinakamalapit na miyembro ng MMDA o PNP.
Kung kayo ay nasa bar, club, restaurant, o anumang privately owned place na open to the public- i-report ang harassment sa security ng lugar.
Sa batas, obligasyon ng mga establishments na ito to provide assistance to victims of sexual harassment by coordinating with local police authorities immediately, making CCTV footage available when ordered by the court, and providing a safe environment that allows victims to report harassment at the first instance.”
Ibig sabihin- required ang bars at clubs na tulungan kayo, at agad-agad na makipag-ugnayan sa pulis para respondehan ang sitwasyon.
Lahat ng tao ay may karapatang maging ligtas, nasaan man sila.
At ang Safe Spaces Act- pinaparusahan ang anumang sexual harassment- kaninuman ito galling, at sinuman ang biktima.
Sa batas- bawal na bawal ang pambabastos sa kapwa.
