Kung ang owner’s duplicate copy ng titulo ay nawala o nasira, ang tamang proseso para sa ganitong sitwasyon ay tinatawag na issuance of new title sa ilalim ng Section 109 ng P.D. 1529 o “Property Registration Decree.”
“Notice and replacement of lost duplicate certificate. — In case of loss or theft of an owner’s duplicate certificate of title, due notice under oath shall be sent by the owner or by someone in his behalf to the Register of Deeds of the province or city where the land lies as soon as the loss or theft is discovered. If a duplicate certificate is lost or destroyed, or cannot be produced by a person applying for the entry of a new certificate to him or for the registration of any instrument, a sworn statement of the fact of such loss or destruction may be filed by the registered owner or other person in interest and registered.
Upon the petition of the registered owner or other person in interest, the court may, after notice and due hearing, direct the issuance of a new duplicate certificate, which shall contain a memorandum of the fact that it is issued in place of the lost duplicate certificate, but shall in all respects be entitled to like faith and credit as the original duplicate, and shall thereafter be regarded as such for all purposes of this decree.”

Angkop lang ito kung nawala o nasira ang kopya ng owner- hindi kung nawala ang titulo na nasa Register of Deeds o kaya naman ay kung may pinagibigyan ang owner at ayaw ibalik.
Sa issuance of title, may dalawang importanteng requirements.
Una- kailangang magbigay ng notice of loss sa Register of Deeds sa lugar kung saan naroon ang lupa (Affidavit of Loss).
Sa Affidavit, ilalagay ang relevant circumstances kung paano nawala o nasira ang titulo at kung paano siguradong wala na ito.
Pangalawa- kailangang mag-file ng kaso o petition for reissuance of title sa Regional Trial Court na may jurisdiction sa lugar. I-aattach ang affidavit of loss sa petisyong ito. Bukod dito, i-aattach rin ang certified true copy ng titulong nasa custody ng Register of Deeds, para malinaw na kayo ang rehistradong owner ng property. Maari ring maghanda ng iba pang proof of ownership halimbawa, tax declaration.
Sa kasong ito, i-dedetermina ng korte sa isang full-blown hearing ang katotohanan sa kung paano nawala o nasira ang titutlo, at kukumpirmahin na ang nagsampa ng kaso nga ang owner ng property.
Kung kumbinsido na ang korte, maglalabas ito ng desisyong nag-uutos na mag-issue ng bagong titulo.
Para magabayan sa mga unang hakbang, pwede kayong sumangguni sa Register of Deeds kung saan naroon ang lupa.
