Ayon sa Article 94 ng Labor Code, ang isang empleyado ay karaniwang may karapatan sa holiday pay katumbas ng isang arawang sahod para sa mga regular holidays. Kung nagtrabaho naman ang empleyado sa araw ng regular holiday, may karapatan siyang makakuha ng holiday pay katumbas sa doble ng kanyang arawang sahod (200% pay). Narito ang batas:
“Article 94. Right to Holiday Pay.— (a) Every worker shall be paid his regular daily wage during regular holidays, except in retail and service establishments regularly employing less than ten (10) workers;
(b) The employer may require an employee to work on any holiday but such employee shall be paid a compensation equivalent to twice his regular rate; and
(c) As used in this Article, “holiday” includes: New Year’s Day, Maundy Thursday, Good Friday, the ninth of April, the first of May, the twelfth of June, the fourth of July, the thirtieth of November, the twenty-fifth and thirtieth of December and the day designated by law for holding a general election.”
Ang mga sumusunod naman ang hindi covered ng batas tungkol sa holiday pay:
- Government employees
- Employees ng retail and service establishments regularly employing less than 10 workers
- Kasambahay and persons in the personal service of another
- Managerial employees kung:
- Their primariy duty is to manage the establishment in which they are employed or of a department or subdivision thereof;
- They customarily and regularly direct the work of two or more employees therein; and
- They have the authority to hire or fire other employees of lower rank; or their suggestions and recommendations as to hiring, firing, and promotion, or any other change of status of other employees are given particular weight;
- Officers or members of managerial staff
- Field personnel and other employees whose time and performance is unsupervised by the employer, including those who are engaged on tas or contract basis, purely commission basis or those who are paid a fixed amount for performing work irrespective of the time consumed in performance thereof
Maaari pa rin naman silang makatanggap nito kung ayon sa kanilang employment contract ay babayaran sila nito ng employer o di kaya naman ay naging establsihed
Ayon rin sa batas, walang karapatan ang isang empleyado sa kabayaran ng holiday pay kung siya ay naka-leave without pay sa araw bago ang regular holiday, at hindi rin siya nagtrabaho sa araw ng regular holiday.
