Pwede itong idaan sa administrative process under R.A. 9048 , as amended by R.A. 10172 , na nag-aallow ng correction in the “sex of a person where it is patently clear that there was a clerical or typographical error or mistake in the entry.”
Pwede kayong mag-file ng petisyon sa lokal na civil registry office kung saan nakarehistro ang birth certificate, para i-request ang correction.
Ito ang general requirements:
- Certified true machine copy of the certificate containing the entry sought to be corrected;
- At least two (2) public or private documents showing the correct entry upon which correction shall be based;
- Publication of petition at least once a week for 2 consecutive weeks in a newspaper of general circulation;
- Certification from appropriate law enforcement agencies of no pending case or no criminal record; and
- Other documents relevant and necessary for the approval of the petition.
Sa correction ng gender, dapat may patunay na angkop nga ang correction- gaya ng baptismal certificate, earliest school documents, at medical records.
Pinaka-importante sa ganitong sitwasyon, required na mag-submit ng certification mula sa accredited government physician na nagsasabing hindi pa dumaan sa medical procedures para ipa-iba ang gender ito. Ibig sabihin- typo lang talaga ang naisulat noong inpinanganak.
Ito ay dahil sa kasalukuyan, wala pa tayong batas na nag-aallow na ipa-iba ang gender sa birth certificate, base sa gender reassignment.
