Sa pangkalahatan hindi po. Ayon sa ating 1987 Constitution, mayoong karapatan ang lahat na maging secure sa kanilang persons at properties laban sa unreasonable searches and seizures:
“Sec. 2. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized.”
Requirement na nakasaad sa search warrant ang lugar, tao, at things na i-ssearch.
Gayunman, may natatanging exceptions para dito:
(1) warrantless search incidental to a lawful arrest;
(2) seizure of evidence in plain view;
(3) search of moving vehicles;
(4) consented warrantless search;
(5) customs search;
(6) stop and frisk situations; at
(7) exigent and emergency circumstances.
Ibig sabihin, depende ito sa mga pangyayari sa naging search. Kung walang kakaibang pangyayari at biglaan na lamang nilang pinasok ang ibang bahay, hindi ito maaaring gawin at paglabag ito ng karapatang pantao.
