Naniniwala ka ba na tungkulin ng mga opisyal ng gobyerno ang maglingkod sa taumbayan?
Na lahat, kahit gaano kataas ang posisyon—pantay-pantay sa batas?
At kung may sala—dapat managot?
Dito pumapasok ang Impeachment! Tara, pag-usapan natin.
Ang Impeachment ay proseso sa ilalim ng 1987 Constitution para panagutin ang pinakamataas na opisyal ng gobyerno kung sila’y lumabag sa tiwala ng taumbayan.
Sila ang mga pwedeng ma-impeach:
- President
- Vice-President
- Members of the Supreme Court
- Members of the Constitutional Commissions
- Ombudsman
Ito naman pwedeng basehan ng kaso:
- Culpable violation of the Constitution
- Treason
- Bribery
- Graft and corruption
- Other high crimes
- Betrayal of public trust
Ang proseso?
Magsisimula sa House of Representatives. Kapag nakakuha ng 1/3 na boto, i-aakyat ito sa Senado.
Sa Senate: May impeachment trial.
May mga Kongresista na magsisilbing prosecutor—sila ang magpe-presenta ng ebidensya.
May abogado naman ang akusado para depensahan siya.
Ang mga senador—sila ang judge na boboto para sa conviction o acquittal sa dulo.
Kapag na-convict, tanggal sa puwesto at disqualified sa future government positions.
Pero tandaan: Impeachment is sui generis—hindi ito criminal case. Walang kulong o bayad-danyos.
Ang layunin nito? Protektahan ang publiko mula sa mga tiwaling opisyal.
Rooted ito sa prinsipyo na: “Public office is a public trust.”
ARTICLE XI
Accountability of Public Officers
SECTION 1. Public office is a public trust. Public officers and employees must at all times be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efficiency, act with patriotism and justice, and lead modest lives.
SECTION 2. The President, the Vice-President, the Members of the Supreme Court, the Members of the Constitutional Commissions, and the Ombudsman may be removed from office, on impeachment for, and conviction of, culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust. All other public officers and employees may be removed from office as provided by law, but not by impeachment.
Ibig sabihin, ang mga opisyal natin—hindi hari, hindi reyna. Ang kapangyarihan nila ay galing sa atin. At kung inaabuso nila ‘yon, may karapatan tayong bawiin ito.
