Ang Prenuptial Agreement ay kontrata sa pagitan ng nagpaplanong ikasal, na may kasunduan sa kanilang property relations.
Ibig sabihin- agreement ito kung paano nila gustong pagsamahin – o pananatiliing hiwalay – ang kanilang pera, property, at income pag kasal na.
Bakit ito ginagawa?
Sa Family Code kasi, kung walang prenup ay Absolute Community of Property ang property mag-aapply sa mag-asawa.
Dito- co-owner ang mag-asawa sa lahat ng property na meron sila nung ikasal, pati na lahat ng makukuha pagkatapos.
At may konting exceptions lang dito:
- Property acquired during the marriage by gratuitous title by either spouse, and the fruits as well as the income thereof, if any, unless it is expressly provided by the donor, testator or grantor that they shall form part of the community property (ex. donation, inheritance);
- Property for personal and exclusive use of either spouse; however, jewelry shall form part of the community property;
- Property acquired before the marriage by either spouse who has legitimate descendants by a former marriage, and the fruits as well as the income, if any, of such property.
May mali ba sa Prenup? Sa tingin ko ay wala naman.
Iba-iba ang values ng bawat couple pagdating sa pera at property, at hindi ito measure sa pagmamahal nila sa isa’t isa
Hindi nasusukat sa pag-share ng property ang pag-ibig. Ang importante- makahanap ng partner na naiintindihan ang iyong values, at kayang pag-usapan at intindihin ito.
At kung nagwowork sa isang relationship ang arrangement nila- pribado ‘yan at dapat ‘di panghimasukan at husgahan ng iba.
