Ang seasonal employment ay kadalasang makikita sa sakahan na ang assignment lang ay tuwing panahon ng anihan.
Dito- ang uri ng trabaho o serbisyong ginagawa ay sadyang seasonal o pana-panahon, at ginagawa habang patuloy ang season.
Halimbawa ng seasonal employees ang farm workers- dahil seasonal o pana-panahon talaga ang pagtatanim, pag-aani, at pag-proseso ng inani.
Sa maraming desisyon ng Supreme Court, ipinaliwanag na “when seasonal workers are continuously and repeatedly hired to perform the same tasks or activities for several seasons or even after the cessation of the season, this length of time may… serve as badge of regular employment.”
Ibig sabihin- kung ang trabahong ginagawa ay kailangan sa karaniwang business ng employer, at kahit seasonal, ay paulit-ulit na pinapagawa sa bawat season sa maraming taon- ang farm worker ay pwedeng ituring na regular employee.
Requisites for attainment of regular employment status by seasonal employee:
- The seasonal employee performs work or services that are seasonal in nature; and
- The seasonal employee is employed to perform such work or services for more than one season.
Ang regular seasonal employees- sa mata ng batas ay hindi natatanggal sa trabaho kapag off-season. Ang turing ng batas- pansamantala lang na on leave hanggang sa susunod na season.
At dahil d’yan- hindi pwedeng basta-basta matanggal sa trabaho ng walang just cause o sapat na rason na pinapayagan ng batas. Kung gawin man ito, maaaring kasuhan ang employer ng ullegal dismissal.
